SSL encryption (sending via the contact form must be encrypted)

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as the requests you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you send to us cannot be read by third parties.

processing of general data and information

With each visit, we collect a series of general data and information via the provider of our website, which is stored anonymously in the log files of the server.

When using the general data and information collected, we do not draw any conclusions about the data subject. Our goal is to use the evaluated general data and information to ensure an optimal level of protection for the personal data we process. The separation of the anonymous general data and information in the server log files from all personal data provided by a data subject is guaranteed.

Google Analytics

This website uses the "Google Analytics" service, which is offered by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA), to analyze website usage by users. The service uses "cookies" - text files that are stored on your device. The information collected by the cookies is usually sent to a Google server in the USA and stored there.

IP anonymization is used on this website. The IP address of users is shortened within the member states of the EU and the European Economic Area. This shortening means that your IP address is no longer personally identifiable. As part of the data processing agreement that the website operators have concluded with Google Inc., Google uses the information collected to evaluate website usage and website activity and to provide services related to internet usage.

You have the option of preventing cookies from being saved on your device by selecting the appropriate settings in your browser. There is no guarantee that you will be able to access all functions of this website without restrictions if your browser does not accept cookies.

Furthermore, you can use a browser plug-in to prevent the information collected by cookies (including your IP address) from being sent to and used by Google Inc. The following link takes you to the corresponding plug-in: https://tools.google.com/dlpage/gaoptout?hl=de
Alternatively, you can prevent Google Analytics from collecting data about you on this website by clicking on this link. By clicking on the link above, you will download an "opt-out cookie". Your browser must therefore generally allow cookies to be saved. If you delete your cookies regularly, you will need to click on the link again each time you visit this website.

You can find further information on data usage by Google Inc. here: https://support.google.com/analytics/answer/6004245?hl=de

newsletter subscription

The website operator offers you a newsletter in which he informs you about current events and offers. If you would like to subscribe to the newsletter, you must provide a valid email address.

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive the newsletter.

To ensure that the newsletter is sent with consent, we use the so-called double opt-in procedure. This allows the potential recipient to be added to a mailing list. The user then receives a confirmation email giving them the opportunity to legally confirm their registration. Only if the confirmation is received will the address be actively added to the mailing list.

We use this data exclusively to send you the requested information and offers.
Our newsletter is sent via “Hubspot”, a CRM system from the provider: HubSpot, Inc., Two Canal Park, Cambridge, MA 02141, USA.

The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on Hubspot's servers in the USA. The service provider Hubspot uses this information to send and evaluate our newsletters on our behalf. Furthermore, Hubspot can use this data to optimize and improve its own services, e.g. to technically optimize the sending and presentation of the newsletter or for commercial purposes in order to determine which countries the recipients come from. However, Hubspot does not use the data of our newsletter recipients to write to them directly or to pass this on to third parties.

We trust in the reliability and IT and data security of Hubspot. Hubspot is certified under the US-EU data protection agreement “Privacy Shield” and is therefore committed to complying with EU data protection regulations. You can find Hubspot’s data protection regulations at https://preferences.hubspot.com/privacy view.

In order to make the newsletter interesting, we statistically record which links have been clicked. However, the analyses are only group-related and are not used by us for individual evaluation. By registering for the newsletter, you agree to this statistical recording.

legal basis for processing

Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the delivery of goods or the provision of other services or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to processing operations that are necessary to carry out pre-contractual measures, for example in cases of enquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as to fulfill tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information had to be passed on to a doctor, hospital or other third parties. In that case, the processing would be based on Art. 6 I lit. d GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f GDPR. This legal basis is used for processing operations that are not covered by any of the aforementioned legal bases if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail. We are permitted to carry out such processing operations in particular because they were specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, Sentence 2 GDPR).

Legitimate interests in the processing pursued by the controller or by a third party

If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the conduct of our business activities for the benefit of the well-being of all our employees and our shareholders.

period for which the personal data will be stored

The criterion for the duration of storage of personal data is the respective statutory retention period. After expiry of the period, the corresponding data is routinely deleted unless it is no longer required for the performance or initiation of a contract.

Legal or contractual provisions

We would like to inform you that the provision of personal data is sometimes required by law (e.g. tax regulations) or can also arise from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary for a data subject to provide us with personal data in order to conclude a contract, which we must subsequently process. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with him or her. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before the data subject provides personal data, the data subject must contact our data protection officer. Our data protection officer will inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences of not providing the personal data would be.

existence of automated decision-making

As a responsible company, we do not use automated decision-making or profiling.

The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to Constin GmbH. By means of this data protection declaration, our enterprise would like to inform the general public of the nature, scope, and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed of their rights by means of this data protection declaration.

As the controller, Constin GmbH has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through this website. However, internet-based data transmissions can generally have security gaps, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us via alternative means, e.g. by telephone.

Changes to this Privacy Policy

We reserve the right to update this privacy policy from time to time. Updates to this privacy policy will be posted on our website. Changes will take effect when they are posted on our website. We therefore recommend that you visit this page regularly to see any updates.
